1. Acceptance of Terms

By downloading, installing or using the EguWallet mobile application ("the App"), you agree to these Terms & Conditions. If you do not agree, do not install or use the App.

2. Description of Service

EguWallet is a European Digital Identity Wallet (EUDI Wallet) compliant with Regulation (EU) 2024/1183 (eIDAS 2.0), developed by IT Eguilde SRL. The App enables storage of digital identity credentials (PID, driving licence, vehicle documents, education and business credentials), selective disclosure of identity data to relying parties, Qualified Electronic Signature (QES) per eIDAS 2.0, and eIDAS 2.0-compliant identity verification.

Note: EguWallet is currently in the eIDAS 2.0 pilot phase, undergoing formal certification by an accredited Conformity Assessment Body (CAB). Credentials issued during the pilot are technically ARF 2.5+ compliant but not yet formally certified as a fully certified EUDI Wallet.

3. Eligibility

• You must be at least 16 years old to use EguWallet
• You must provide accurate and complete information at registration
• You are responsible for maintaining confidentiality of your wallet PIN
• You may not transfer wallet access to any third party

4. User Responsibilities

• Protect your PIN and biometric authentication — do not share them
• Report any unauthorised access or device loss immediately to contact@eguwallet.eu
• Do not use the App for illegal or fraudulent purposes
• Do not attempt to reverse-engineer, decompile, or tamper with the App
• You are responsible for all actions performed through your wallet

5. Digital Credentials and Legal Force

Digital credentials issued by EguWallet have legal force under Regulation (EU) 2024/1183 when presented to Relying Parties (services and authorities) that accept EUDI Wallets. Qualified Electronic Signatures (QES) made with EguWallet have the same legal value as handwritten signatures across the EU under eIDAS 2.0 Art. 25. You are responsible for verifying that any Relying Party accepts and recognises EUDI Wallet before using the App for legally binding transactions.

6. Limitation of Liability

To the extent permitted by applicable law: IT Eguilde SRL is not liable for losses caused by improper use of the App, device loss, or PIN compromise. The App is provided "as is" in the pilot phase — we do not guarantee uninterrupted availability. We are not responsible for decisions by third parties (services, authorities) regarding acceptance or rejection of your digital credentials.

7. Intellectual Property

EguWallet, the EguWallet logo, and all associated materials are the property of IT Eguilde SRL. The App incorporates EUDI open-source libraries (Apache 2.0) and other third-party components, each under their respective licences.

8. Data Protection

Processing of your personal data is described in our Privacy Policy. Use of the App constitutes acceptance of data processing in accordance with that policy and GDPR (EU) 2016/679.

9. Changes to Service and Terms

We reserve the right to modify the App, its features, or these Terms at any time. Material changes will be communicated through the App or by email at least 30 days before they take effect. Continued use after changes constitutes acceptance.

10. Suspension and Termination

You may delete your wallet at any time from within the App (Settings → Delete Wallet). We reserve the right to suspend access in cases of fraudulent use, violation of these Terms, or legal requirements. Upon termination, all local data is deleted; server data is removed within 30 days.

11. Governing Law

These Terms are governed by Romanian law and applicable EU regulations, including Regulation (EU) 2024/1183 (eIDAS 2.0) and GDPR (EU) 2016/679. Any dispute shall be resolved by competent courts in Romania. You may also refer disputes to ANPC (anpc.ro) for alternative consumer dispute resolution.
